Draft Shops and Establishments (Second Amendment) Rules, 2026: Proposed Changes to Registration, Forms and Fees

Published: Sep 28, 2026

The Gujarat Government has published draft amendments to the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2020. The proposals cover employee thresholds in specified rules, registration procedures, changes to registration particulars and prescribed forms.

For employers and HR teams, the key point is that this Gazette publication invites public comments on draft rules. It should not be treated as the final notification bringing these proposed amendments into operation.

What does the draft propose?

1. Replace “ten” with “twenty” in specified rules

The draft proposes replacing “ten” with “twenty” in Rules 3, 4, 6 and 10. It also changes the wording in Form I to refer to establishments engaging fewer than twenty workers.

Employers should assess these proposals alongside the applicable provisions of the parent Act. The draft should not be read as a blanket exemption from all employment obligations for establishments with fewer than twenty workers.

2. Revise the registration process

Under the proposed Rule 5, an employer would submit Form A, online or otherwise, with the required documents and prescribed fee. The registration certificate would then be generated online or issued otherwise in Form B.

Details of registered establishments would be entered in the Form C Register of Establishments.

3. Report changes in registration particulars within 30 days

The proposed Rule 9 requires an employer to apply in Form G within 30 days of a change in the particulars contained in the registration certificate.

The application would need the documents specified in Part C of the Schedule and the prescribed fee. A revised registration certificate would then be generated or issued.

The proposed Form G fees for establishments employing twenty or more employees are:

Category

Proposed fee

Establishments

₹500

Shops

₹500

Residential hotels

₹2,500

Restaurants and eating houses

₹1,000

Theatres and other places of public amusement or entertainment

₹5,000

These fees relate to applications for changes in registration particulars under the proposed Rule 9.

4. Replace Forms B and C

The proposed Form B records establishment details and separate manpower information for managerial or supervisory personnel, other workers, apprentices, contract labour and part-time workers.

It also states that the certificate is based on the applicant’s declarations and self-certified documents, without physical verification. Registration does not confer ownership, possession or other property rights over the premises.

Form C would also be replaced with a revised register format.

Opportunity to submit objections and suggestions

The Government has provided 30 days from Gazette publication for objections and suggestions.

Representations may be submitted to:

What should employers do now?

Review registration records, manpower classifications and internal processes for reporting changes. Identify any practical concerns for submission during the consultation period, and monitor the final notification before implementing changes based solely on this draft.
