Gujarat Trade Unions Directed to Align Constitutions with Industrial Relations Code, 2020

The Office of the Labour Commissioner, Gujarat, through a notice dated 29 August 2026, has directed all trade unions registered under the Trade Unions Act, 1926 to ensure that their constitutions and internal rules comply with the Industrial Relations Code, 2020.

The Industrial Relations Code came into force across India on 21 November 2025. Under Section 9(4) of the Code, trade unions already registered under the Trade Unions Act, 1926 will be deemed to have been registered under the new Code, provided their constitutions comply with the requirements prescribed under Section 7.

Accordingly, every registered trade union in Gujarat must submit an undertaking, along with the prescribed supporting documents, to the appropriate labour authority on or before 31 December 2026.

If a union’s existing constitution does not comply with Section 7 of the Industrial Relations Code, it must first amend its rules by following the procedure laid down in its constitution. The amended constitution and supporting records must then be submitted for verification.

Documents to be submitted

Each trade union is required to submit:

  • A duly signed undertaking;

  • Copy of the trade union registration certificate;

  • Updated constitution or rules of the union;

  • Comparative statement showing the existing and amended provisions;

  • Records of the latest union election;

  • Minutes and records of the relevant general body meeting;

  • Latest audited annual return in Form XXI; and

  • Updated list of union members.

Appropriate authority for submission

The place of submission will depend on the territorial reach of the trade union:

  • Union operating within one district: Assistant Labour Commissioner of the concerned district;

  • Union operating across more than one district within the same region: Deputy Labour Commissioner of the concerned region; and

  • State-level or multi-region union: Office of the Labour Commissioner, Gujarat State, Gandhinagar.

The notice refers to the communication issued by the Registrar of Trade Unions, Gujarat State, Gandhinagar, dated 29 August 2026. No separate notification number has been mentioned.

Compliance deadline

All required documents must be submitted by 31 December 2026. Trade unions that fail to file the undertaking and supporting documents within the prescribed time, or whose constitutions remain inconsistent with the Industrial Relations Code, 2020, may face cancellation of their registration.

Registered trade unions should therefore review their constitutions immediately, complete any necessary amendments through the prescribed internal process, and file the complete set of documents well before the deadline.
