Rajasthan has notified the Rajasthan Industrial Relations Rules, 2026 through Notification S.O. 41 dated 12 August 2026. Issued by the Labour Department, Government of Rajasthan, the Rules were published in the Rajasthan Gazette Extraordinary on the same date and came into force from 12 August 2026.
The final Rules follow the draft published on 20 January 2026, which invited objections and suggestions for 45 days. They have been framed under Section 99 of the Industrial Relations Code, 2020. The Rajasthan Labour Department's official notification page confirms the earlier draft publication.
Key Highlights
The new framework supersedes the existing Rajasthan rules relating to industrial disputes, standing orders and trade unions.
The Rules contain 13 chapters, 64 rules and 20 prescribed forms, covering trade unions, negotiating unions, standing orders, industrial disputes, strikes, lock-outs, retrenchment and closure.
A Works Committee may be required in notified establishments, with worker representatives not being fewer than employer representatives.
The Grievance Redressal Committee can have up to 10 members, with equal representation of employer and workers.
Trade Union registration requires at least 7 members, along with prescribed documents and declarations.
Where more than one registered union exists, a union having support of 51% or more workers is recognised as the negotiating union. If no union reaches 51%, a Negotiating Council is constituted in accordance with the Code.
Recognition is generally valid for 3 years and may be extended up to 5 years by mutual agreement.
Industrial establishments employing 300 or more workers are subject to the enhanced standing-order and prior-permission framework under the Code.
Employers retrenching workers must contribute 15 days' last-drawn wages towards the Worker Re-skilling Fund.
Strike and lock-out notices must be reported to the prescribed authorities.
The Rules also provide procedures for settlement, conciliation, adjudication, appeals and compounding of offences.
Employers in Rajasthan should now review their standing orders, grievance mechanism, union recognition processes and retrenchment/closure procedures.
