Effective: 4 Sept 1974

The Assam Shops and Establishments Act, 1971 is a state labour legislation enacted to regulate the working conditions of employees employed in shops, commercial establishments, restaurants, theatres, and other establishments in the State of Assam. The Act provides a legal framework governing registration of establishments, working hours, overtime, weekly holidays, leave entitlement, employment of women and young persons, payment of wages, and maintenance of statutory registers. Its primary objective is to ensure fair labour practices, employee welfare, and proper regulation of commercial activities in establishments that are not covered under the Factories Act. Under this Act, employers are required to register their establishments with the Labour Department, maintain prescribed records, and comply with provisions relating to working hours, rest intervals, weekly offs, and leave with wages. The Act also empowers labour authorities to inspect establishments and enforce compliance, with penalties prescribed for violations. • Until the new codes are notified in Assam, the existing acts and rules listed above remain in force.
  • States may draft their own rules under the new codes, which may differ from the central rules in certain aspects.
